Terms and Condition

1. Who we are and how these terms work

County Road 12 Bookstore is a division of Clox LLC. We operate the online bookstore located at ericjonesbooks.com and sell books and related digital products and merchandise. By visiting our site or buying any product you agree to these Terms and Conditions. If you do not agree, please do not use the site or place an order.

These terms form a binding agreement between you and Clox LLC. We may update these terms at any time by posting a new version on the site. The new version applies to orders placed after it is posted.

2. Key definitions

  • Bookstore means County Road 12 Bookstore, a division of Clox LLC.
  • Site means ericjonesbooks.com and any linked pages we control.
  • Digital Content means ebooks or audiobooks purchased from us.
  • Vendors means BookFunnel, IngramSpark, Amazon, Spreadshop, Soundwise, Stripe, and any other service providers we use.

 

3.What we sell and how fulfillment works

We sell print books, ebooks, audiobooks, and book inspired merchandise.

  • Print books. Most print orders are placed through IngramSpark. In some cases we may route orders through Amazon. Printing, payment, shipping, and customer service for these print orders are handled by the Vendor that processes the order. Their policies apply to those transactions.
  • Digital Content. We sell ebooks and audiobooks on our site. BookFunnel delivers the Digital Content to you after purchase. BookFunnel is our delivery partner. They do not own the content.
  • Merchandise. Apparel and other items are produced and fulfilled by Spreadshop. Spreadshop handles payment, production, and shipping for those items. Their policies apply.
  • Affiliates and alternative delivery. We may use Soundwise for backup delivery or for affiliate sales and referral links. If an order is completed through Soundwise, Soundwise delivery and access rules apply to that order.

 

4. Who may use the site

You must be at least the age of majority where you live to place an order. If you are under the age of majority you need permission from your parent or legal guardian.

5. Orders and contract formation

Placing items in your cart does not create a contract. A contract forms when your payment is successfully processed and we or our Vendor send a confirmation. We may refuse or cancel an order for any lawful reason. If we cancel an order after you have been charged we will refund the full amount for that order.


6. Pricing, taxes, and availability

Prices are shown in United States dollars unless stated otherwise. Prices and availability can change without notice. You are responsible for any sales tax, VAT, duties, or import fees that apply to your purchase. If a price is obviously incorrect we may cancel the order and refund you.


7. Payments

Payments for purchases made on our site are processed by Stripe. By completing a transaction you authorize Stripe to charge your selected payment method and you agree to Stripe’s separate terms and privacy practices. We do not store your full payment card details on our servers.

For print books purchased through IngramSpark or Amazon, and for merchandise purchased through Spreadshop, the Vendor will process your payment and their terms will apply.


8. Shipping and delivery

– Print books. Printing and shipping time frames are set by the Vendor that processes the order. Risk of loss for physical items transfers to you when the item is delivered to the carrier.

– Merchandise. Production and shipping schedules are set by Spreadshop. Risk of loss transfers upon delivery to the carrier.

– Digital Content. Delivery occurs when BookFunnel makes the content available to your account or by email link. If you do not receive a delivery email, check your spam folder and then contact BookFunnel support or write to us at info@countyroad12.com.

We are not responsible for delays caused by carriers, customs, strikes, natural events, or Vendor system outages.


9. Digital Content license and access rules

When you purchase Digital Content you receive a limited, personal, non transferable, non exclusive license to access and enjoy that content for your own private use.

  •  All ebooks and audiobooks are hosted and delivered through BookFunnel.
  •  You may access and enjoy your purchases only through the BookFunnel website or BookFunnel app as enabled by your account.
  • You do not receive direct file downloads unless BookFunnel explicitly provides this as part of your purchase.
  •  You may not copy, save, rip, upload, share, transfer, resell, or distribute the Digital Content.
  • Any attempt to bypass BookFunnel access controls or to capture or redistribute files is a violation of these terms and of our copyright.

If BookFunnel updates its app or access methods you agree to install updates or follow new instructions to keep access working on your devices.
10. Intellectual property
All content on the site including books, text, images, graphics, logos, and audio is owned by County Road 12 Bookstore or its licensors and is protected by United States and international laws. You may not use our content except as allowed by these terms or with our prior written permission.

County Road 12 Bookstore and related names, logos, book titles, and brand features are trademarks or service marks of Clox LLC. Nothing in these terms grants any license to use our marks.


11. Reviews, comments, and user content

If the site allows reviews or comments you agree that your submissions will be lawful and respectful. You grant us a worldwide, royalty free license to use, reproduce, display, and distribute your submissions in connection with the site and our business. We may remove any submission at our discretion.


12. Promotions and coupons

We may run promotions or offer coupons from time to time. Each promotion may have additional terms. If there is a conflict, the promotion terms control for that promotion.


13. Preorders

If we offer preorders, estimated release dates are for planning only and may change. Your payment method may be charged at the time of preorder or at release depending on the checkout flow. Preorders are covered by our refund policy below.

14. Refund policy

All sales are final. No refunds or exchanges will be issued for any product.

We provide two narrow exceptions for digital purchases made through our site

  •  If your ebook or audiobook is corrupted, inaccessible, or fails to download through BookFunnel, we will provide a replacement link after we verify the issue.
  •  If you make an accidental duplicate purchase of the same title, we will refund the duplicate charge after we verify the order details.

For print books purchased through IngramSpark or Amazon you must follow their refund, replacement, and customer service procedures. For merchandise fulfilled by Spreadshop you must follow Spreadshop’s procedures.

15. Chargebacks and order issues

If you have a problem with an order please contact us first at info@countyroad12.com so we can help. If you file a chargeback with your bank without giving us a chance to resolve the issue we reserve the right to block your account or refuse future orders.


16. Prohibited uses

You agree not to

  • use the site for any unlawful purpose
  • infringe our intellectual property or the intellectual property of others
  • attempt to gain unauthorized access to the site or to our systems
  • interfere with site security or performance
  • use any scraper, spider, or similar tool to copy content without permission.


17. Third party services and links

The site links to services operated by our Vendors including BookFunnel, IngramSpark, Amazon, Spreadshop, Soundwise, and Stripe. We do not control these services and are not responsible for their content, security, or practices. Your use of those services is governed by their terms and privacy policies.

18. Privacy

Our Privacy Policy explains what data we collect and how we use it, including marketing communications, cookies, and data sharing with Vendors for order fulfillment. By using the site you agree to the Privacy Policy.


19. Disclaimer of warranties

The site and all products are provided as is and as available. We do not promise that access will be uninterrupted or error free. We disclaim all warranties to the fullest extent allowed by law, including implied warranties of merchantability, fitness for a particular purpose, and non infringement. You are responsible for confirming device and software compatibility before you buy.


20. Limitation of liability

To the fullest extent allowed by law, County Road 12 Bookstore, Clox LLC, and our affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses. For any claim related to a purchase, our total liability will not exceed the amount you paid for that specific product.

Some jurisdictions do not allow certain limitations. If a limitation is not enforceable in your location, the remaining limitations still apply.


21. Indemnification

You agree to indemnify and hold harmless County Road 12 Bookstore, Clox LLC, our officers, employees, and agents from any claim, loss, liability, or expense including reasonable attorneys’ fees that arises from your misuse of the site or Digital Content, your violation of these terms, or your violation of any law or the rights of a third party.


22. Governing law

These terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules.


23. Binding arbitration and class action waiver

Any dispute, claim, or controversy arising out of or relating to these terms or your use of the site or our products will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Wyoming. The arbitrator may award any relief that a court could award, subject to the limitations in these terms.

You and the Bookstore agree that each may bring claims only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, private attorney general, or representative proceeding. The arbitrator may not consolidate claims of more than one person and may not preside over any form of representative or class proceeding.

You may choose to pursue an individual claim in small claims court in Wyoming if the claim is within that court’s jurisdiction.

24. Force majeure

We will not be liable for any delay or failure to perform due to causes beyond our reasonable control including natural disasters, acts of God, war, terrorism, labor disputes, epidemics, power failures, internet failures, Vendor outages, or the actions of civil or military authorities.


25. Changes to the site or products

We may change or discontinue any product or feature without notice. We may limit quantities or refuse service to anyone for lawful reasons.


26. Assignment

We may assign our rights and obligations under these terms to any affiliate or in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations without our prior written consent.


27. Severability

If any part of these terms is found unenforceable, that part will be enforced to the maximum extent allowed and the rest will remain in full force.


28. Entire agreement and no waiver

These terms, together with any order confirmation and our Privacy Policy, are the entire agreement between you and us regarding your use of the site and your purchases. Our failure to enforce any right is not a waiver of that right.
